1. Legal Basis

1.1. The EU General Data Protection Regulation, the Data Protection Act 2000, and the Data Protection Adaptation Act 2018 serve the right to protect personal data. We process your data exclusively on the basis of legal provisions (GDPR, DSG 2018, TKG 2003).

2.2. We are particularly concerned with protecting and securely storing any personal data you entrust to us. In this document, you will learn more about how we use and process your personal data.


3. Purpose, Legal Basis, Retention Period and Data Recipients

3.1. The personal data collected is required for processing your orders. If you do not wish to provide any data, you can also pick up our products directly at our business in Schleedorf and pay in cash without placing an order through the webshop. For payment by credit card, bank transfer, instant transfer, cash on delivery, and delivery with open invoice, as well as for the delivery of your order to the desired address, we require your name, address, delivery address, e-mail address, and phone number. For payments by instant transfer and bank transfer, your name and account number will appear on our bank statements, which we must archive in accordance with the legal retention requirements, along with other accounting documents, and pass on to our tax advisor. Additionally, when delivering the order to you, it is necessary to forward the address data to our shipping service provider and indicate it on the package. If you are purchasing as a business with a VAT number for tax-exempt net prices, we must also pass your data and VAT number to the tax office. The data will be collected, stored, processed, and used for this purpose.

3.2. The legal grounds for processing your personal data are, on the one hand, the fulfilment of a contract (if you wish to shop online or have the goods delivered to your home, or need an invoice issued in your name), legitimate interests, the fulfilment of our legal or contractual obligations, and on the other hand, your consent (e.g. contact form, newsletter, cookies). Failure to provide the data may have different consequences. An anonymous purchase – without providing your data – is of course possible if you pick up the goods from us and pay in cash.

3.4. We process your personal data (name, address, delivery address, e-mail address, and phone number, as well as account details) as required for the duration of the entire business relationship (from initiation, processing to termination of a contract) and beyond according to legal retention and documentation obligations, which arise, among others, from the Austrian Commercial Code (UGB), the Federal Tax Code (BAO), as well as until the termination of any legal disputes, ongoing warranty, and guarantee periods.

3.5. In the course of operating our websites, we commission shipping and payment service providers, tax advisors, software service providers, and agencies who, in the course of their activities, may gain access to your personal data, provided they need the data to fulfil their respective services. These parties have committed to complying with applicable data protection regulations towards us. Data processing agreements have been concluded in accordance with Art. 28 GDPR. 3.6. The address data required for the delivery of your order (name, address, phone number, e-mail address) will also be passed on to Österreichische Post Aktiengesellschaft (Rochusplatz 1, 1030 Vienna, E-mail: kundenservice@post.at, Tel.: +43 577 670) or the shipping service provider Hermes Logistik GmbH & Co KG (Concorde Business Park 1, D 1/7, AT – 2320 Schwechat, Tel.: +43 (0) 50 4376-37, E-mail: info@hlg.at).


4. Contact Form

4.1. Your details, including personal data from our contact form, will be transmitted to us via our own mail server for processing your inquiry, further processed, and stored. This data will not be collected or shared without your consent. Without this data, we cannot process your inquiry.

4.2. Data processing is based on the legal provisions of § 96 para. 3 TKG and Art. 6 para. 1 lit. a (consent) GDPR.


5. Newsletter

5.1. You can subscribe to our newsletter on the website, which is done via the double opt-in process. After registering, you will receive an email asking you to confirm your subscription. Without providing this data, we cannot send you our newsletter. You can unsubscribe from the newsletter by clicking the unsubscribe link at the end of each newsletter.

5.2. For sending our newsletter, we commission processors. These have committed to complying with applicable data protection regulations towards us. 6. Online Shopping

6.1. We would like to point out that, in order to simplify the shopping process and for later contract processing, we store the IP data of the connection holder through cookies, as well as the name, address, e-mail address, phone number, account details, credit card number, and date of birth of the buyer. The data you provide is necessary for contract fulfilment or the performance of pre-contractual measures. Without this data, we cannot conclude the contract with you. If you do not wish to provide your data, you can also shop directly at our premises in Schleedorf and pay in cash.

6.2. The address data, as well as the e-mail address and phone number, will be forwarded to Österreichische Post Aktiengesellschaft or Hermes Logistik GmbH & Co KG for the purpose of having the delivery made to your desired delivery address. A transfer of your address data, e-mail address, phone number, and credit card, debit card, and bank card details will be made to our payment service providers, Stripe, Paypal, for payment processing. Your address data, e-mail address, phone number, and account details will also be passed to SOFORT for payment processing in case of payment by instant transfer. Your data will also be forwarded to our tax advisor for the fulfilment of our tax obligations. These parties have committed to complying with applicable data protection regulations towards us. 6.3. Data processing is based on the legal provisions of § 96 para. 3 TKG and Art. 6 GDPR (in particular consent and/or necessity for contract fulfilment).


7. Cookies, Other Tracking Tools, and Web Analytics

7.1. Cookies, other tracking technologies, and features of the web analytics service Google Analytics, Google Adwords, and the shop itself may be used in various ways on our online platform. Cookies are small text files that enable recognition of the user and analysis of your usage of our websites. The information generated by this is transferred to and stored on the provider’s server. These cookies serve to make our online presence more user-friendly, effective, and secure. Additionally, cookies are used to measure the frequency of page views and for general navigation purposes.

7.2. By using our website, you consent to the setting of cookies. You can refuse the acceptance of cookies in your browser settings. 7.4. Your IP address is collected but immediately pseudonymised (e.g. by deleting the last 8 bits). This allows only a rough localisation.

7.5. Data processing is based on the legal provisions of § 96 para. 3 TKG and Art. 6 GDPR (in particular consent). Since we value the privacy of our users, the user data is pseudonymised.


8. Consent and Right to Withdraw

8.1. If your consent is required for the processing of your data, we will process it only after your explicit consent.

8.2. In principle, we do not process data of minors and are not authorised to do so. By giving your consent, you confirm that you are over the age of 14 or have obtained the consent of your legal representative.

8.3. You can withdraw your consent at any time by emailing office@stoffn.at. In such a case, the data previously stored about you will be anonymised and subsequently used only for statistical purposes without personal reference. The withdrawal of consent does not affect the legality of processing based on the consent prior to its withdrawal.


9. Data Security

9.1. Our Managing Director, Sebastian Reindl, implements technical and organisational security measures to protect the stored personal data against accidental or intentional manipulation, loss or destruction, and against unauthorised access. Our security measures are continuously improved in line with technological progress.


10. Your Rights

If no legal retention obligation exists, you have the right to have this data deleted and to object to its processing.
